Sacramento Sheriff’s Sergeant Won’t Be Retried for DUI

The Sacramento County District Attorney’s Office won’t refile DUI charges against a sheriff’s sergeant whose first trial ended with a hung jury.

Christopher Dayton Guerrero was pulled over for DUI on Oct. 4, 2007 in Roseville but was not arrested or cited even though he reportedly had a BAC of .16 percent - twice the legal limit.

The District Attorney’s Office filed DUI charges against him after a local TV station reported the arrest, but jurors couldn’t agree on his guilt, so the judge declared a mistrial. Prosecutors declined to refile the case because they believed a second trial might have the same outcome.

Man Pleads Not Guilty in DUI Death of Angels Pitcher

The San Gabriel man accused of driving drunk and killing Angels pitcher Nick Adenhart and two of his friends has pleaded not guilty to murder and DUI charges.

Andrew Thomas Gallo, 22, pleaded not guilty in Orange County Superior Court to three counts of murder, drunk driving and fleeing the scene of an accident. Police said Gallo’s blood alcohol content was three times the legal limit when he reportedly ran a red light and struck the car in which Adenhart was riding. He faces 55 years to life in prison if convicted on all charges.

Orange County Man Indicted in Angels Pitcher DUI Death

An Orange County man has been indicted in connection with the DUI death of Angels pitcher Nick Adenhart and two others.

Andrew Thomas Gallo, 22, was indicted by an Orange County grand jury on three counts of second-degree murder, fleeing the scene of a traffic collision involving death or injury, driving under the influence that caused injury and driving with a 0.08 percent blood alcohol level or more that caused injury.

Gallo was on probation for another DUI conviction in San Bernardino County at the time of the April 9 crash.

Police made 82 DUI arrests in Ventura County this year between Friday morning and Monday night, compared to 102 drunk driving arrests during Memorial Day weekend last year.  In 2007, police made 120 DUI arrests in Ventura County during Memorial Day weekend.
