NFL Player Jason Shirley Convicted of DUI / DWI in Fresno

November 12th, 2008

Cincinnati Bengals defensive lineman Jason Shirley was sentenced to 30 days in a work program after he was convicted of DUI / DWI and hit and run in Fresno.

Shirley, whom police said had a blood alcohol content (BAC) of .12, was retried after his first trial ended with a hung jury.

Although it may not seem that way, a hung jury is often a victory for the defense in a California DUI / DWI case. In many cases, the prosecutor will decline to retry the case after having difficulty convincing 12 jurors of the driver’s guilt beyond a reasonable doubt.

If you’re facing a California DUI / DWI charge, it’s important to have an experienced drunk driving defense lawyer fighting for your rights. October 27th, 2008

A Stockton woman was arrested for California DUI / DWI after she drove over a center median in an effort to avoid a sobriety checkpoint.

Kelley Holmes, 21, is charged with driving while intoxicated, reckless evasion of a peace officer, speeding and failure to provide proof of insurance.

It isn’t illegal to avoid driving up to a sobriety checkpoint in California, but it is against the law to drive over a median.  By doing so, Holmes exposed herself to more charges than she would have had she merely encountered the sobriety checkpoint.

October 15th, 2008

A bus driver who was initially arrested for felony DUI / DWI in connection with a crash that killed nine senior citizens traveling to a Northern California casino was not under the influence of alcohol or drugs and won’t be charged, police said.
