California County Awarded Grant to Track Repeat DUI Offenders

Monday, January 5th, 2009

Butte County officials have been awarded nearly $370,000 to track repeat DUI offenders to ensure that they are complying with the terms of their probation.

The two-year grant will pay the salaries of one dedicated probation officer and one technician who will also conduct bar sweeps to search for convicted DUI drivers who are violating the terms of their probation by drinking even if they aren’t driving.

The terms of probation after a California DUI conviction are typically very restrictive, and the surest way to avoid them is to not get convicted of drunk driving in the first place. Fortunately, it’s possible to fight and win against a California DUI charge with the help of a skilled defense lawyer.

Teen Will Serve One Year for Fatal Sacramento DUI Crash

Tuesday, December 23rd, 2008

A 17-year-old who ran a red light at 80 mph while drunk and killed a man will serve one year in juvenile detention and then be deported, a Sacramento judge has ruled.

The teen, whose name was not released, will be deported to his home country after serving a year at the Sacramento County Boys Ranch.

One year in detention is an extremely light sentence in a DUI death case, even for a juvenile. Many individuals convicted in DUI deaths are sentenced to years of incarceration.

Legal Experts Believe Alcohol-Sensing Flashlights Used in California DUI Investigations May Violate Drivers’ Rights

Friday, December 12th, 2008

Police in Alameda County and elsewhere in California are beginning to use flashlights equipped with alcohol sensors to snare drunk drivers, but legal experts have voiced concerns that the devices violate drivers’ rights.

The ACLU of Northern California has pointed out that police need a driver’s permission to perform a preliminary alcohol screening test, or PAS test, but the $750 flashlights provide the same information without the driver even being aware that he or she is being tested.

Once a driver is arrested on suspicion of DUI / DWI, police don’t need permission to perform a blood or breath test - drivers are required by California’s implied consent law to submit to a chemical test after a drunk driving arrest.

If you were arrested for California DUI / DWI, you need a defense lawyer with the advanced scientific and legal knowledge to challenge the evidence in your drunk driving case. An experienced California DUI / DWI attorney from The Kavinoky Law Firm is here to help. Please contact us today at 1.877.4NO.CUFFS for a free consultation.
